Abstract
The purpose of this scientific article is to present the crime of fighting contained in the new Criminal Code of Romania in the Special Part, Title I Crime against the person, Chapter II Crime against bodily integrity or health, it is intended to be a theoretical, doctrinal and practical analysis By highlighting the application of the sanctioning rule. Investigating the fraudulent offense resulting from the provisions of Art.198 National Criminal Code of Romania, compared to the old Criminal Code, we notice that it has undergone changes in the content of the criminality, but also in the sanctioning regime, as well as its permutation from the chapter Other crimes that affect social cohabitation relations, Because the Romanian legislator considered that the special legal object of the fight is formed by the social relations whose normal formation, development and development depend on the protection of the bodily integrity and the health of the person.
