MODERN FORMS AND METHODS OF THE ACTIVITY OF NATIONAL POLICE AGENCIES IN THE FIELD OF PROTECTING CHILDREN RIGHTS

Abstract
The article is focused on characteristics of certain modern forms and methods of the activity of the agencies of the National Police of Ukraine regarding the protection of children rights, freedoms and legitimate interests. At the same time, the author does not deviate from their classical classification. The forms of the activities of the National Police were divided into legal and illegal or organizational, and methods – into coercion and persuasion. The author of the article has noted that despite all the positive dynamics of the development of “man/child – police” relations, there is still a number of unresolved and debatable issues. This includes, in particular, the formation and maintenance of children records, the provision of interaction, the uncertainty of the competence of specially authorized subjects to protect the rights of children, the lack of procedural norms, which must form the mechanism for the implementation of material norms, etc. The research reflects the main directions of the development of the state policy on the application of measures of influence against minors. The author has separately noted that the vector of the application of coercion is gradually changing, despite the dominant position of imperative prescriptions. Particular attention deserves the interaction between the agencies of the National Police of Ukraine and local self-government agencies in guaranteeing the proper level of the development of children and their protection, as reflected in the relevant regional programs. In the conclusions, the author has emphasized that the activity of the agencies of the National Police of Ukraine should be based more on methods of persuasion, rather than on coercion. The latter, in turn, should be applied only in extreme cases when other methods of legal regulation were exhausted and did not give a positive result and there is still the danger to the rights, freedoms and legitimate interests of children.
