A commentary on the Supreme Court’s Judgment of October 19, 2016 (Ref. No. III CZP 5/16)

Abstract
The problem of the transfer of warranty for physical defects to a third person has been analysed for many years by very respectable lawyers and judges. It seemed that the Supreme Court had solved the problem by its verdict of 5 February 2004. However, the Supreme Court in its judgement of 19 October 2016 admitted that the right to withdraw from an contract of sale involving a faulty product can be transferred to the recipient. The purpose of the commentary is to analyse the content of Supreme Court’s verdict.
