A consular jurisdiction and the trial of foreigners. The case of Constantinos Zappas v. Anton and Constantin Toma (1865-1872)

Abstract

During the nineteenth century, the elimination of consular jurisdiction was one of the most important points on the Romanian government's foreign policy agenda. From the diplomatic missions to the organic laws and constitutional provisions, the Romanian policy tried, at any cost, to meet this goal; in fact, just after independence, it was reached. The process of Constantin Záppas and Constantin brothers is just one of many examples of processes in which the Romanian justice and consular authorities have disputed their jurisdiction. The solution given by the High Court of Cassation and Justice proves, once again, the determination of Romanian authorities to limit the duties’ effects which consuls understood to accomplish in Romania.
