About European standards concerning the appointment of judges of common courts (based on the experience of the Venice Commission)

Abstract

The process of restoring a democratic judiciary in the countries of Central and Eastern Europe has proved to be an extremely difficult and lengthy one. An important role in the process of searching for these solutions and „discovering” European standards has been played by the Venice Commission from the very beginning of its existence. It should also be noted that the legal standards concerning the judiciary in the area of the Council of Europe were significantly convergent with the standards formulated by the European Union, as demonstrated by the subsequent EU adhesion processes.
