ACTUAL ISSUES OF LEGAL PROVISION OF START-UPS FUNCTIONING

Abstract

Problem setting. The construction of an innovative state requires the harmonious and timely development of the National Innovation System. This process will lead to the development of an integrated mechanism of regulating relations in the innovation system and its subsystems.The legislative framework of legal regulation of Ukraine's innovation activity is functionally incomplete and underdeveloped. This problem outlined the scope of development of small innovative enterprises, namely start-ups. Target of research. The purpose of the article is to highlight the existing shortcomings of modern legislation regarding the development of innovation activities in determining the essence and features of start-ups in terms of functional and institutional aspects. Analysis of recent researches and publications. The problems of the development of start-ups in modern society are studied in various fields of law and economics. This trend is of interest to both the scientific community and practitioners, investors, entrepreneurs, including: W. Weisser, D. Zbanatsky, J. Wong, E. Buchatsky, B. Dorf, G. Drew, K. Zacarias, B. Treasury, O. Kardakov, O. Mas, D. Stavytsky, P. Til and others. Article's main body. The main direction of NIS functioning is to increase the innovation activity of small and medium enterprises that is inextricably linked with the emergence of new innovative companies - start-ups. Its successful implementation in the modern market is the basis of the development of innovation processes in the economy. Small and medium businesses represent a significant and potential part of the country's economic development. An important impetus for its development may be the creation of innovative projects or small innovative enterprises as business entities - start-ups. Conclusions and prospects for the development. Based on this study of the legal nature of start-ups, we can conclude that such a subject has its own characteristics that distinguish it from other NIC subjects. The dynamic development of innovation activity in Ukraine stimulates the need to determine the peculiarities of legal regulation of start-ups activities and the protection of their rights to intellectual property objects. It's necessary to develop and submit to the Verkhovna Rada of Ukraine draft laws on the development of innovation activities in Ukraine on the basis of the draft Strategy of Ukraine's Innovation Development, as well as relevant subnormative legal acts that will provide legislative support for start-ups, the principles of their functioning, the definition of legal status, and types of state support.
