ADVANCE PAYMENT AND ADVANCE PAYMENT AS THE BASIS FOR THE EMERGENCE OF CREDIT RELATIONS

Abstract
The article is sanctified to research of advancing and previous payment, as meth- ods of implementation obligations that simultaneously come forward as grounds of origin of credit obligations, in particular, relations of the commercial crediting. Es- sence of concepts «advance» and «previous payment» are set, a conclusion is argued that they are correlated as special in relation to general, the cases of payment to the advance and advance form by a soba all possible variants of previous payment. It will be that the use of terms «advance» and «previous payment» in a century 1057 Civil Code of Ukraine through who conflicts with them to the correct understanding. The features of maintenance of agreements that contain terms about advancing and previous payment are investigated.
