AN ENTREPRENEUR IN AGRIBUSINESS IN THE LIGHT OF THE AMENDED PROVISIONS OF THE BANKRUPTCY AND RESTRUCTURING LAW

Abstract

The paper concerns the possibility of applying the provisions of bankruptcy law and restructuring law with regard to natural persons, legal persons and organizational units not being legal persons, which the law recognizes the legal capacity, leading farm. It is justified by both the financial situation of the agricultural sector, as well as new regulations effective from 1st January 2016. The authors present status of these entities as entrepreneurs and rules applicable to them. Considerations suggest the preferential rules applicable to insolvent or threatened insolvency of natural persons leading farm that do not conduct any other business or profession.<br/><br/>
