ANALYTICAL REVIEW OF THE ILLEGAL CUTTING OF TREES AS A CRIMINAL OFFENSE

Abstract
The analytical aspects of illegal cutting of trees in Ukraine were highlighted in the article. The analysis of quantitative and qualitative indicators of cutting of trees, registered by the domestic law enforcement authorities was made. The structure accounted criminal offenses in the illegal cutting of trees was investigated. The author conclusions on the identified trends, based on the analysis results were formulated. The research of illegal cutting of trees is very topical, especially for Ukraine. The objective current trend is the criminalization of illegal cutting of trees that creates conditions for the growth of the shadow sector in the lumber industry. In order to prevent the depletion of forest resources of Ukraine there was established the requirements and the responsible unlawful attacks on this natural object by the modern law of Ukraine. Massive deforestation, including illegal, in our country leads to soil erosion, depletion of rivers, negative climate changes, which affects people’s lives. The analysis of the illegal cutting of trees led to the conclusions that: 1. The negative trend of quantitative growth of illegal cutting of trees was established because during 2013–2015 there was increasing of amount this type of crime, accounted by the law enforcement authorities of Ukraine. 2. The effectiveness of the law enforcement authorities towards identifying of suspects of illegal cutting of trees over the past three years has decreased by 1,5 times, because the share of criminal offenses in which individuals served notice of suspicion in the total number of criminal offenses has trend to reduction. In addition, there was established an increase of share of criminal offenses in which the decision is not accepted at the end of the reporting period in the total number of accounted criminal offenses for the analyzed period. The identifying threatening trends of illegal cutting of trees contribute to the need to develop effective measures to combat this negative phenomenon.
