Application of different values in canon and civil process

Abstract

Both canon and civil process represent an instrument of substantive law rules application, yet implemented on a different value basis. In a civil cause, a legal subject is subordinate to the value law, in which the society as well as legislator’s values are reflecting though not necessarily indentical with subjects values themselves. In contrast, canon law in reflecting God´s law, does not or should not subordinate to the current society needs, on the contrary – it should act as a guard of God’s truth. Canon law subjects are supposed to act as bearers of indentical values with the Church worths. Consequently, in a canon cause contradictory values should not collide and the cause itself should aim to reveal the truth and fulfill the main goal – salvation of soul. By analyzing values and their application in civil and canon law, we have tried to point at diverse worth, its application and aims between canon and civil law system and to emphasize the specificities and divergences of both law systems as well as their possible consequences for legal norms addressees.
