BASIS AND PROCEDURE FOR TERMINATION OF AN EMPLOYMENT CONTRACT WITH THE HEAD OF AN ENTERPRISE, INSTITUTION, ORGANIZATION: WAYS OF IMPROVEMENT

Abstract

Problem setting. In our time, in the difficult conditions of the development of the national economy, the issue of regulating the work of the head of the organization is very relevant. The specificity and complexity of the legal status of the head is determined by the wide range of powers, functions, responsibilities that are assigned to it, as well as the problems of the correlation of norms of labor and corporate law, their application in practical situations, which may encounter any modern organization. The specifics of the work of the head of the enterprise, institution, organization are based on a special role and significance of his work for the successful work of the entire organization and the special responsibility of the head for the entire organization of labor and production. Features of the legal status of the manager, his special role in the management process determines the need for strict compliance with the laws in the process of termination of the employment contract, because the wrong design of the procedure of dismissal of the head of an organization can lead to serious problems, even to block the work of the enterprise. In particular, cases in Ukraine where a leader who considers himself unfairly dismissed or dismissed without observing the established procedure keeps documents and the seal of the organization that leads to the impossibility of making payments, reporting, etc. It is precisely such situations in-depth study of those aspects related to the grounds and procedure for termination of an employment contract with the head of an enterprise, institution, organization, require the study of issues relating to the termination of an employment contract with persons holding senior positions. Analysis of recent researches and publications. Questions concerning the termination of a work contract with employees in recent years were investigated in his writings by A. I. Protsevsky, A. O. Kovalenko, A. O. Babenko, E. V. Babenko, K. Yu. Melnik, Ya. A. Anniversated, V. V. Zhernakov, S. M. Prilipko, A. M. Yaroshenko and others. Target of research. The purpose of the article is to analyze the terms of termination of a work contract with the head of the enterprise, institution, organization and search for ways to improve it. The article considers the grounds and the procedure for termination of an employment contract with the head of the enterprise, institution, organization, these grounds are concretized, suggestions are made regarding the improvement of the procedure for termination of an employment contract with the head of the enterprise, institution and organization. On the basis of the analysis of labor law in terms of termination of an employment contract with the managers, it was concluded that the role of the contractual form of an employment contract with the purpose of strengthening the role of providing the managers and owners of enterprises, institutions and organization of the right to independently determine the grounds and procedure for the termination of an employment contract Conclusions and prospects for the development. Summing up this article, we note that the existing Labor Code regulates the issue of contracting comprehensively, but at the same time issues concerning the termination of an employment contract, in particular, an employment contract with the head of an enterprise, institution or organization, are insufficiently regulated by domestic labor legislation. To resolve this issue, it is necessary to strengthen the role of the contractual form of the employment contract, to provide managers and owners of enterprises, institutions, organizations the right to independently determine the grounds and procedure for termination of an employment contract.
