Abstract

The concept of information security includes the protection of confidential information and other clas-sified information protected by law, personal data and the rules on access to public information. Thus, information security refers to the protection of the interests of the state and the citizens. At times it is difficult to distinguish these interests. In this article the author presents the legal regulations concern-ing the protection of confidential information and other classified information protected by law in Poland, the European Union and NATO. He indicates that the protection of confidential information has not been harmonized in the legislation of the EU. That is why within the scope of confidential information that is protected only on a national level there is no EU regulations, which would indicate the ways and rules of proceedings. The situation is different when it concerns classified information that is coming from the organs of the EU: the European Council and the European Commission. The Republic of Poland, as well as the other member states of the NATO, have committed themselves to protect classified information using common security rules and standards, which apply in this alliance. The principal point of reference that established the rules for information security and the procedures in this area, is the document entitled: “Security within the North Atlantic Treaty Organization” (Document CM (2002) 49 from the 17th of June, 2002). The author points out that bilateral agree-ments are signed, both between the member states of the NATO as well as with other states. The main objective of such agreements is the mutual protection of confidential information
