[b][i]Public Duties, Limitations and Privileges of the Private Bank[/i][/b]

Abstract
The paper attempts to extract from the act on banking law the regulations which establish public duties, limitations and privileges of private banks. Public duties, limitations and privileges of private banks are more extended than those pertaining to entrepreneurs operating under common law, as they were adjusted to the specific situation of banks. They did not appear overnight, but have been developing gradually, and in the last years they have been influenced significantly by the European law. For this reason, they do not constitute a consistent system. However, they supplement each other. They correspond to the peculiar character of the bank activity which is saturated with variegated risk factors. They constitute a kind of counter- balance to the risk involved in banking activity and therefore there are no reasons to limit or abolish them.
