[b][i]Summary Proceedings. Remarks de Lege Ferenda[/i][/b]

Abstract

The Austrian Empire was the first state to introduce summary proceedings in its legislation (art. 49 Constitutio Criminalis Theresiana from the 31st of December, 1768). In the Austrian law from the 3rd of September 1803 it was stated that the purpose of summary proceedings is “to carry out investiga-tions in the shortest time possible when necessary, as well as instantly judge guilty defendants and immediately execute the punishment”. The author includes various remarks about summary proceed-ings in his article. For example, according to him the law concerning summary proceedings should include an anticipatory solution. He also remarks that in these kinds of proceedings only absolute punishment of imprisonment is ruled, which is not below, for example, half the sentence provided by law for a given crime, and when the crime is subject to imprisonment for at least five years, the court gives a sentence of 25 years of imprisonment or life imprisonment.
