[b][i]The Boundaries of Protection of Unborn Life in the Polish Criminal Law System[/i][/b]

Abstract
The Author discusses, basing on the Polish criminal law – the Penal Code from 1997, from what mo-ment the developing human organism has the right to life and health protection within the criminal law system and from what moment it has the right to enjoy full protection. He suggests to look at the entire “scope” of the human life, in its broadest sense – from the moment of conception all the way through to the death of the brainstem. This way it is easier to present the issues of criminal law protec-tion, based on the Polish law. Investigating the intensity of this kind of protection leads to the conclu-sion that a human is fully protected from the moment that the birth process is completed all the way through to the death of the brainstem. This protection is lower during the birth process and even more limited in the period before actual birth when the organism is not able to survive independently out-side of the organism of the mother, and it is the least from the moment of conception until the moment that the organism reaches the ability to survive on its own.It seems, while observing the social reality in Poland, that the solutions of the Criminal Code from 1997, together with the standardization of the law that defines the circumstances for aborting preg-nancy, being the result of a social compromise, are currently the optimal solution. It can also be sug-gested, as it was done with the amendment project of the Constitution of 1997, to set the boundary of the protection of human life within the criminal law system at the moment of conception, although the protection of the very beginnings of the human life may require new legal regulations, based on en-tirely different principles than the life of human beings. Thus, the principal topic of doubts and argu-ments turns out to be the human embryo as the subject of protection in the criminal law system, espe-cially in the early stages of its development. However, in this area an ideological compromise is not possible (this argument concerns values), but on a legal level, involving politicians and parliamentari-ans, it will be necessary. The same goes for the issue of regulating the matter of in vitro fertilization. However, this topic, for obvious reasons, will not be discussed in this article, even though it is a very important social matter and has lately become the subject of very valuable, although not always free from emotions, and more than resolute discourses.
