Centralny Rejestr Restrukturyzacji i Upadłości jako instytucja ułatwiająca dochodzenie roszczeń w postępowaniu restrukturyzacyjnym i upadłościowym

Abstract
Th e article discusses the assumptions and functions of the Central Register of Restructuring and Bankruptcy, which is to enable it to make notices and postings of decisions, orders and documents issued in the course of bankruptcy and restructuring proceedings. It has been noted that the legislator distinguishes between the notion of publication and posting in the Register. These institutions sometimes refer to different provisions, orders and documents and have different legal consequences. It was noted that the provisions on the Register have not yet entered into force. According to the wording of art. 455 of the Restructuring Law, until the day on which the Register is created, the Court and Commercial Gazette, while the orders and documents to be included in the Register shall be delivered to the Court Registry, which shall be mentioned in the operative part of the order with the date of presentation. During the transitional period, letters and documents are submitted to the case fi le in paper form, although the Act provides that the letters or documents may be submitted in electronic form. The register is to improve bankruptcy and restructuring proceedings, enable faster implementation of the claim and increase the level of its satisfaction. W artykule omówiono założenia i funkcje Centralnego Rejestru Restrukturyzacji i Upadłości, który ma umożliwić dokonywanie w nim obwieszczeń i zamieszczeń postanowień, zarządzeń i dokumentów wydanych w toku postępowania upadłościowego i restrukturyzacyjnego. Zwrócono uwagę, że ustawodawca rozróżnia pojęcie obwieszczenia i zamieszczenia w Rejestrze. Instytucje te odnoszą się niekiedy do różnych postanowień, zarządzeń i dokumentów i wywołują odmienne skutki prawne. Zaznaczono, że przepisy o Rejestrze nie weszły jeszcze w życie. Zgodnie z brzmieniem art. 455 ustawy Prawo restrukturyzacyjne, do dnia utworzenia Rejestru obwieszczeń dokonuje się w Monitorze Sądowym i Gospodarczym, natomiast zarządzenia i dokumenty, które powinny być zamieszczone w Rejestrze, wykłada się w sekretariacie sądu, o czym należy uczynić wzmiankę na sentencji postanowienia z zaznaczeniem daty wyłożenia. W okresie przejściowym pisma i dokumenty składa się do akt sprawy w postaci papierowej, mimo że ustawa przewiduje, że dane pisma lub dokumenty składa się albo można złożyć w postaci elektronicznej. Rejestr ma usprawnić postępowanie upadłościowe i restrukturyzacyjne, umożliwić szybszą realizację roszczenia i zwiększenie stopnia jego zaspokojenia.
