Certification of fishing vessel personnel: international standards and implementation in Ukraine

Abstract

The article reveals some aspects of the implementation of the international standards for the certification of fishing vessel personnel established by International Convention on Standards of Training, Certification and Watchkeeping for Fishing Vessel Personnel (1995) and International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (1978). The author notes the imperfection of standard-setting techniques of the acts introducing the norms of these conventions into national Ukrainian legislation. The author also emphasizes the absence of a final wording of the names of the conventions in Ukrainian due to the impossibility of a proper translation of the English word “certification”. The use of the term “certification” is considered to be fully justified for the personnel of fishing vessels and seafarers of maritime merchant vessels. Its use in the names of the relevant conventions is valid and better than translating the word “certification” as “gaining a diploma” in the name of the STCW Convention '78 and adopted national legislation.
