Classification of preventive measures in criminal proceedings of Ukraine

Abstract
The research paper entitled determines the procedural and legal meaning of preventive measures in criminal proceedings. Using the comparative legal method, an author’s definition of the concept of “preventive measure in the criminal proceedings” is suggested. The author also suggests in his research paper to understand the definition of “home arrest in domestic criminal proceedings” as a preventive measure which consists in imposing restrictions on the freedom and other rights of a suspect or accused person, established by a court award, without holding him in custody and without full isolation from society provided the availability of grounds and in accordance with the procedure established by the Criminal Procedural Code of Ukraine, taking into account age, state of health, marital status and other circumstances. In turn, the practical significance of the classification of preventive measures is that with the help of such a division it is possible to identify, to find out, to comprehensively explore various features, properties of each type of preventive measure and to determine the most optimal ways of their use, practical application to the suspect, the accused, etc. Taking into account the above, the preventive measures in criminal proceedings has been classified into separate groups using a certain common ground and the preventive measures have also been described by a certain direction.
