Journal Title: Revista Institutului Național al Justiției - Year 2016, Vol 37, Issue 2

Abstract

The Sixth Amendment to the United States Constitution enumerates a cluster of rights granted to criminal defendants and is designed to make criminal prosecutions more accurate, fair, and legitimate. The Confrontation Clause, which states that „In all criminal prosecutions, the accused shall enjoy the right…to be confronted with the witness against him” should not be underestimated. This article seeks to analyse the evolution of the Confrontation Clasue and the extent of a defendant’s right to face-to-face confrontation. The article analyse the case Crawford v. Washington, which was a key shift in the Supreme Court’s Confrontation Clause jurisprudence.
