Conscientious objection versus human rights and their philosophy

Abstract

Freedom of conscience and its manifestation visible in the form of conscientious objection, occupy a special place in systems aimed at protecting human rights. They are one of the fundamental cornerstones upon which democratic states of law are built. Without such guarantees pertaining to freedom of conscience, one cannot even begin to discuss the notions of a free society and free individuals. The presented article therefore reviews the philosophical underpinnings of conscientious objection, its ratification in systems aimed at protecting human rights, with a particular focus on the system of the Council of Europe, covering its importance to the democratic state of law.<br/><br/>
