Constitutional improvement of human responsibilities and citizens of European states

Abstract

The article deals with the constitutional practice of normative regulation of the duties of a person and a citizen in Ukraine and 42 states of continental Europe. On the basis of comparative legal analysis, the volume of constitutional consolidation of the duties of a person and a citizen in different European countries is determined. It is proved that the provisions of the Constitution of Ukraine, in which the obligations of a person and a citizen are fixed, are essentially substantive correspondence and correlate with international legal acts on human rights. But despite this, they need to improve, taking into account the European experience of constitutional consolidation of the rights of a person and a citizen. They should be clear, of equal importance and understandable to each citizen, to take into account the socioeconomic conditions that have developed in our country, as well as the traditions and mentality of the people, the level of legal culture and legal awareness of the population, and the state of law and order in the state. It is grounded that the constitutional and legal nature of the duty is disclosed in the provisions of Art. Art. 23, 26, 35, 41, 51, 53, 57, 65, 66, 67, 68 of the Constitution of Ukraine, which stipulate 14 obligations of a person and a citizen, which is the largest among all other constitutions of the states of continental Europe. In addition, one of the peculiarities of constitutional and legal regulation of obligations is that they are not systematized, but scattered in the text of the Constitution of Ukraine and therefore do not form a single bloc.
