Current legal problems concerning use of lot lands of farms

Abstract

Problem setting. The legal problems of the use of lot lands of farms are analysed in the article, in particular, in the aspect of necessity of change of the having a special purpose setting of these areas at building on them of objects of the real estate. Article’s main body. A conclusion is done, that in the case of necessity of building of various objects of the real estate on lot lands of farms, the landed legislation of Ukraine requires to change them having a special purpose setting (proper part of lot land). However given out such change is in relation to earths of the agricultural setting for the conduct of commodity agricultural production in this time is impossible through the prohibition fastened in a legislation. Moreover, the resulted orders in relation to the necessity of change of the having a special purpose setting of earths do not conform to the norms of the Landed code of Ukraine et al normatively legal acts which give a right proprietors and zemlekoristuvacham to erect the proper objects of the real estate, in particular, on earths of the agricultural setting, which are given for the conduct of farm. Conclusions and prospects for the development. With the purpose of perfection of legislation of Ukraine in part of building of objects of the real estate on lot lands of farmer economies track in the Landed code of Ukraine to fasten, that building is on earths of the agricultural setting of objects, in cases certain by the Landed code of Ukraine et al normatively legal by acts, conducted without the change of them having a special purpose setting. In same queue, to Law of Ukraine «On a farm» it follows to add orders, that: (a) building of the separated homestead is conducted on lot lands, given for the conduct of farm, without the change of them having a special purpose setting; (b) a farm and his cocks in accordance with a law have a right to erect dwelling-houses, economic buildings and buildings, on lot land, given for the conduct of farm, without the change of it having a special purpose setting.
