CURRENT STATE OF IMPLEMENTATION OF SOCIALLY USEFUL WORKS IN UKRAINE

Abstract
The article is devoted to the research of problems and prospects of introduction of a new type of administrative penalty in Ukraine. The main stages of implementation of socially useful works are highlighted. One of the direction for improvement of the legislation in the sphere of children rights protection was the first package of laws initiated by the Ministry of Justice of Ukraine that strengthen the responsibility of parents who do not pay child support payouts for years and the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on the Creation of Economic Preconditions for Strengthening the Protection of the Child’s Right to Proper Maintenance” adopted by the Verkhovna Rada of Ukraine, due to which the Code of Ukraine on Administrative Offenses (hereinafter referred to as CAO of Ukraine) is supplemented with a new type of administrative penalty. The study of the effectiveness of administrative penalty in the form of socially useful work in Ukraine and the activities of authorized agencies on probation allowed both to ascertain a positive role of the new penalty and to identify significant problems of its implementation. Bringing persons to administrative responsibility is considered as an effective means of combating administrative offenses. The guilty parties in commitment of such offense are subjected to an administrative penalty provided by the sanction of a relevant article of CAO of Ukraine. It is used for the purpose of educational influence on the offender, as well as to prevent the commission of other offenses. As a result of the analysis of the types of penalties, one can identify the common features inherent to them such as: the educational and compulsory nature of penalties; they are applied by court decision and only to individuals; a common circle of people to whom they cannot be applied; a similar procedure for their performance and an authority authorized to exercise control over their execution.
