Ćwiczenia z wyobraźni – „Samotnia” Charlesa Dickensa w prawniczym curriculum

Abstract
Artykuł wpisuje się w dziedzinę badań nad relacją pomiędzy prawem i literaturą. W jego pierwszej części, na przykładzie Samotni Charlesa Dickensa, wskazano ograniczenia nurtu law in literature. Krytykę podejścia utożsamiającego rolę pisarza z rolą historyka prawa osadzono w szerszym kontekście - chodzi o krytykę wizji literatury jako wiernego odwzorowania rzeczywistości społecznej, w tym prawniczej. W części drugiej artykułu, cały czas odwołując się do zagadnień z Samotni (sąd kanclerski, środowisko prawnicze, filantropia), zaproponowano odmienny sposób postrzegania literatury w obrębie edukacji prawniczej. Nie naśladownictwo, lecz literacki artyzm (m.in. metafory, personifikacje, karykatury) uznano za wartościowe z punktu widzenia kształcenia prawników narzędzie rozwoju ich wyobraźni moralnej i wrażliwości.
