Deffects of Medical Care Provision: Notions and Types (Дефекти надання медичної допомоги: поняття та види)

Abstract
The definitions of the terms concerning the defects of medical care provision were suggested. The difference between the accident, medical error and professional crime was described, the main specific features of each of the phenomena were defined and proposals as regards to improvement of the national laws, optimization of legal realization and legal application were developed. The classification of defects of medical care according to different criteria was conducted. Among such criteria the main attention was paid to the criteria of evaluation of legal consequences. The reasons for defects of medical care provision were clarified, in particular low qualification level of medical professionals, careless and unfair fulfillment of one’s professional duties by medical providers, improper organization of medical care provision, noncompliance of the standards in the sphere of health care; formal attitude towards a patient. Defects of medical care provision were illustrated by the court practice along with the analysis of the court hearing of medical cases.
