Abstract
The article is devoted to the question of the attribution of intentional destruction or damage of property to one of the types of violations of the laws or customs of war for which criminal responsibility is stipulated in Article 438 of the Criminal code of Ukraine. Analyses the main international documents defining the list of serious violations of International Humanitarian law. Criteria of differentiation of deliberate destruction or damage of property as one of types of violation of laws and customs of war, from other adjacent crimes are defined.
