DEMOCRATIC SHAPING OF THE POLITICAL WILL OF SERBIAN CITIZENS

Abstract

The article deals with the analysis of certain constitutional and legal provisions of the Serbian legal system concerning some of the issues of concern to political parties. The same goes for the tumultuous and brutal historical and legal legacy of political parties in Serbia in the 19th century as well as their reckless and constant struggle. The aim of the article is to investigate the possible weak points of Serbian democracy in terms of the constitution of political parties and to make conclusions about whether there is a place to the improvement of democracy and how it could be achieved. After more than a decade of the existence of the 2006 Constitution, in constitutional practice and theory, many practical and theoretical issues have been set yet to provide answers that would satisfy the majority. One of the central issues concerns the examination of a "secret association" by the Constitutional Court of Serbia, or the disputed issue of jurisdiction to act on its prohibition. The second issue more directly related to the question of democracy in Serbia is the legal and theoretical concept of the prohibition of political parties whose theoretical basis was founded by Carl Levenstein during the Second World War and relates to problems related to the establishment of democracy in this region.
