ДЕРЖАВНО-РЕЛІГІЙНІ ПОГЛЯДИ НА ШЛЮБ У БОЛГАРІЇ ТА УКРАЇНІ

Abstract

Today, at the state level in most countries of the world marriage is perceived as a kind of contract, which is concluded between the three sides – a man, a woman and a state. A hard family that lives in legal marriage is the foundation of the state. The welfare of the state is related to the welfare of the family. Without a family institution a state can not exist. Marriage – a voluntary union between a man and a woman, which is concluded in accordance with the established procedure with observance of the requirements of the law, is aimed at creating a family. Marriage generates mutual personal and property rights and duties of the spouses, which arise from the moment of state registration of real family creation. Marriage is concluded without specifying its term of action. Introduction to marriage involves the desire of the spouses to maintain marital relationships throughout their lives. However, this does not mean the impossibility of termination of a marriage, for example, when changing the relationship between spouses in the negative side. Religious (church) marriage, that is marriage concluded from religious rites – in the church, mosques, synagogues, etc. – is not a marriage in legal sense and has no legal consequences. A religious marriage can be concluded before or after the state registration of the creation of a family in the civil registry authorities, but not instead of such registration. Unlike written legal laws, religious norms regulate marital relations with the help of morals, traditions and customs. Among them are the rules of courtship, marriage choice, pre-marital behavior, the upbringing of children, the division of power and responsibilities between spouses, etc. That is the religious perception of the concept of “marriage” is wider than the general state. According to religious norms, marriage is a great blessing given by God, the purpose of marriage is marriage. And today, insisting on the need for a church marriage (“If the Lord does not build a house, the workers who build it work in vain” (Is. 126.1) [3]), the pastors of the Orthodox Church respect the civil marriage – the state understanding of the concept of “marriage”, because understand that marriage is introduced in order to realize the life of mutual love, that is to destroy individual isolation, to expand the personality (“the life of one person in two hypostases”). Most citizens in Bulgaria and Ukraine are Orthodox Christians. Both in Bulgaria and in Ukraine the Orthodox Church and religious organizations are separated from the state and it is not surprising that the views on marriage vary. The purpose of writing this article is to describe the concept of “marriage”; compare the understanding of marriage in Bulgaria and Ukraine in terms of religion and the state. The state and religious perception of marriage in Bulgaria and Ukraine are very similar, almost identical. The difference lies in the perception of this concept by society. The church stands only for the legal marriage between a man and a woman, it must be indissoluble, and integrity, unity, loyalty and fecundity should manifest between the spouses in it. It has been established that in the modern world the Basic Laws of the state coincide with the Word of God, which is clearly described in this scientific article. However, religion is more harsh on some issues, such as the concept of “marriage”: according to the laws of both countries, it is possible to break a family, but in the religious sense “marriage that is concluded in heaven is eternal”. A strong family living in legal marriage is the basis of the state. The welfare of the state is interconnected with the well-being of the family. Without the institution of the family, the state cannot exist.
