Detention on Suspicion of a Crime and Custody: Practice of the European Court of Human Rights and Ukrainian Realities

Abstract

This article analyzes the legal position of the European Court of Human Rights in terms of such preventive measures as detention on suspicion of committing a crime and custody. The findings of the monitoring of the application of the Criminal Procedure Code by Ukrainian courts and the activities of the Ombudsman concerning the compliance with procedural law and the right to freedom at the early stage of criminal proceedings have been studied and presented in the article. On the basis of the analysis of the legal position of the European Court of Human Rights certain requirements for the application of Part 1 of Article 5 of the Convention for the Protection of Human Rights and Fundamental Freedoms, in particular, regarding the conditions, goals, purpose and use preventive measures have been found out. The article focuses on the necessity to adhere to the principle of proportionality in making a decision on the choice of the preventive measures, i. e. to balance the possibility of providing the immediate fulfillment of the obligation and the right to freedom in a democratic society. The attention is paid to the need for further harmonization of the provisions of the Criminal Procedure Code in this sphere defining clearly the acceptable risks under which the preventive measures can be applied, and the possibility to prove them in court. A number of amendments to the Criminal Procedure Code have been suggested with the aim to improve the efficiency of judicial control over the activities of the bodies conducting the pre-trial investigation and also strengthen the protection of rights of the persons detained on suspicion of a crime and those who are held in custody.
