DEVELOPMENT OF ECONOMIC LEGISLATION OF UKRAINE AT THE SECOND STEP OF DOMESTIC ECONOMIC REFORMS

Abstract

Problem setting. Description of legal regulation of economic relations in independent Ukraine should take into account an influence of governmental economic policy and problems of adaptation to further market transformations of the economy. Recent research and publications analysis. Analysis of historical development of the economic law has been done by V. K. Mamutov, H. L. Znamenskyi, P. H. Skrypnyk, and V. A. Ustymenko. However, the mentioned authors have not taken sufficient notice of the history of economic relations as a subject to regulation of the economic law and to an influence of the latter on a level of systematization and modernization of the economic legislation in general. Paper objective. The article objective is to analyze the sense and the orientation of the state law-making activity in an area of economic and legal regulation at the second step of legislative support of development of the market economy in Ukraine. Paper main body. The sense of the economic legislation in a period of improvement of the executed reforms of 1993-1994 should be referred to as more systematic legal providing the economic activity carried out due to harmonization of combination of economic and productive as well as organizational and economic components of regulation. One of the main reasons of improvement of the national legislation is beginning a procedure of integration of Ukraine into the world community. This step is stipulated by internal as well as external factors. Among them the most influential are integrational and globalization processes. Conclusions of the research. In the period of reformatory improvement, the legislation is described by the following characteristics: norms are established by the state and provided by the state compulsion; a business entity is vested with particular rights and obligations; norms establish certain rules of behavior and injunctions regarding their application and execution by all the entities of legal relations; norms must be determined by a normative act, a law, an order, a resolution, a decree, or an instruction. Short Abstract for an article Abstract. The article is dedicated to development of the economic legislation at the second step of reformation of the market economy in Ukraine, systematization, and a process of formation of the field legislation in this period. The author has analyzed outcome legal statements concerning each field economic and legal complex formed during this period. Having done system analysis, the author has indicated inevitability of processes of the economic legislation codification.
