DEVELOPMENT OF THE CONCEPT OF “INFORMATION SECURITY” IN THE LEGAL DIRECTION: THEORETICAL ANALYSIS

Abstract
The article presents a brief overview of scientific legal literature, primarily the Ukrainian one, which analyses information security as a political and legal phenomenon that takes in not only the notion of information protection, but also organizational, political, legal and other actions aimed at ensuring a sustainable, stable development of society and the state. The global nature of the information sphere, which is growing objectively, leads to the fact that the information and communication infrastructure created by this or that country and national information resources is very vulnerable to the influence of geopolitical rivals, terrorist organizations, criminal groups, and individual malefactors. One of the most important areas for studying information security issues is its legal aspect. The purpose of the article is a brief review of scientific legal literature, first of all domestic, which analyses information security as a political and legal phenomenon, which includes not only the protection of information but also organizational, political, legal, and other measures aimed at ensuring stable, sustainable development of society and state. No modern society can exist and function without a system of legal regulation of relations in the information sphere, protection of the legitimate interests of citizens, society, and the state in the development of information space. As a result, enforcement of the constitutional rights and freedoms of citizens naturally involves the legal regulation of information activities of individual citizens, as well as state authorities, the media, and also organizations that ensure the functioning of media and communication systems. Theoretical and legal problems of ensuring the safety of the individual, society, and the state, legal regulation of the organization and operation of institutes of protection of the state system are presented in publications of domestic and foreign scientists. At the same time, despite the considerable attention given by the researchers to the problems of the information society, discussing issues of ensuring Ukraine’s information security, the formation and implementation of the state policy of Ukraine in this area, a number of aspects are still poorly developed, which complicates the creation of an effective system of ensuring information security of the state.
