DIFFICULT LIFE CIRCUMSTANCES AS A PRECONDITION FOR THE CONCLUSION OF THE CONTRACT OF PATRONAGE ON CHILD IN UKRAINE

Abstract
The article deals with the problems relating to understanding the “difficult life circumstances” as a precondition for the conclusion of the contract of patronage on a child. On the basis of analyses of the norms of the current legislation of Ukraine, as well as of the scientific literature it has been proven that the category of “difficult life circumstances”, in the form in which it is codified in current regulations, does not meet the requirements of law enforcement practices in the context of patronage relationships. It is also proposed to amend Sec. 6. Cl. 1 of the Law of Ukraine “On ensuring the organizational and legal conditions for the social protection of orphans and children deprived of parental care”, in relation to the form of placements of orphans and children deprived of parental care, by placement of a child into foster family caregiver.
