DISCRIMINATION AS AN EXAMPLE OF EMPLOYEE UNEQUAL TREATMENT

Abstract

In common understanding the word “discrimination” means distinction. Dictionaries as well as encyclopaedia consider discrimination to be “impairment or persecution of individuals or social groups due to their origin, racial, ethnic, denominational, national or class affiliation”. Discrimination in this aspect consists in treating individuals or groups worse than the commonalty due to their “alterity”. Equality of every citizen is the key rule of modern democratic societies. A ban on discrimination is the foundation included within the framework of international law and EU law and in Poland it is the constitutional rule and the rule of labour law. The ban on discrimination is mainly emphasizing and strengthening the rule that everybody is equal before the law and should be treated the same in the same situations. The Constitution of the Republic of Poland says in article 32 that everybody shall be equal before the law. Everybody has the right to equal treatment by public authorities. Nobody should be discriminated in political, social or economic life for any reason.<br/><br/>
