Dismissal pay: legal nature, problems of currently in force and perspective legal regulation

Abstract
The issue of legal nature of dismissal pay is considered in the present scientific paper. In Ukrainian science of labour law the discharge pay is commonly considered to be a kind of either warranty payments, or compensative payments. It is ascertained that the dismissal pay by its essence, nature concerns neither compensative payments nor warranty payments and appears to be a different specific payment, sui generis. Some particular problems of currently in force and perspective legal regulation of dismissal pay relationships are considered. Dismissal pay may be defined as a specific monetary payment that has nothing to do with the other payments settling with the dismissed employee, and is paid to the dismissed employee according to the legal provisions of law and collective agreement, if the labour legal relationships were terminated for the specific range of legal reasons ascertained by the legal provisions of law and collective agreement. The interpretations of dismissal pay as one of the social maintenance payments and as one of the legal responsibility measure seems to be fallacious. Currently in force and perspective legal regulation of dismissal pay relationships in Ukraine, unfortunately, do not meet the legal demands of the International Labour Organization Convention concerning Termination of Employment at the Initiative of the Employer№ 158 in full measure. The draft Labour Code of Ukraine provides some novels concerning legal regulation of dismissal pay relationships. Those novels on the whole may be estimated positively. They approximate Ukrainian labour law to the provisions of Labour Organization Convention concerning Termination of Employment at the Initiative of the Employer№ 158. It is reasonable to adopt the dismissal pay volume differentiation depending on the labour experience in all cases when it should be paid.
