Abstract

Problem setting. In Ukraine began the phase of playback structures inherent in a market economy through the adoption of several laws. But, the post-Soviet specifics of these processes has led to the fact that there was an economic concentration and the formation of powerful financial-industrial groups. As a result, a powerful group of large businesses with a monopoly position in the relevant markets was formed. For these, the activity of big business requires clear economic and legal frameworks from domestic legislation. Recent research and publications analysis. Phenomenology of big business, its legal regime of functioning have been considered in the works of D. V. Zadykhailo, Stadnyk K. O., Plavshuda K. V. Paper objective. The article purpose is to determine economic and legal features of companies’ activities of big business. Paper main body. It is worth mentioning that qualification or identification criteria for economic organizations of big business do not exist in the legislation or are distinguished by their dysfunctional. This is also important for «sync» conceptual apparatus of the tax and economic legislation, which in many ways defines economic organizations of big business. But the state has not established a clear legal policy for regarding economic organizations of big business. This is unacceptable, considering value, the sense and the controversial interaction of big business with other segments of the national economy and actors of political and informational relations. Policy of Ukraine for small and medium enterprises development does not contradict the need to form and pursue a policy of collaboration with the big business organizations. After all, big business has a significant functional load for the state economy through strong export-orientation, innovative capacity and competitiveness of products on world markets, the positive social aspect of its activities. All this determines the significant state public interest to these groups of enterprises. As a rule, the economic organizations of big business are created in the form of holding associations. However, legal regulation for economic organizations activities of holding type is undeveloped and requires significant improvements. There is active problem of economic power transformation of big business powerful organizations in political and information power. This trend requires active action and effective regulation by public authorities. Conclusions of the research. Thus, it’s necessary to improve the functioning of legal economic order and economic mechanism of regulation activity of the macroeconomic authorities for improving the efficiency of economic processes of the state, which involved big business organizations. These problems can be solved by improving the relevant sectoral legislation. Short Abstract for an article Аbstract. The paper has delineated the problematic issues of legal regulation activities of the economic organizations of big business. The author states that absence of effective concepts of big business organizations creates obstacles of economic and legal regulation of these economic relations. The author recognizes the main negative and potentially progressive economic characteristics of big business. The author substantiates necessity of detailed legislative regulation of all aspects of the relevant macroeconomic authority representatives.
