Abstract

In today’s conditions of the development of processes of global internationalization of all spheres of life, the attention of the international community focuses mainly on consolidating the efforts aimed at combating crime, which has recently undergone qualitative and quantitative transformation. The development of communication tools, the emergence of the Internet, the simplification of passport control, the existence of «transparent» borders between the states formed in the former USSR, the imperfection of national mechanisms for combating crime is a far incomplete list of factors that contribute to avoiding perpetrators of criminal prosecution one or another state, criminal liability. Under such conditions, international cooperation of states in the fight against crime plays a special role by providing legal assistance in criminal cases, one of which forms is the extradition of persons, or extradition. For Ukraine, which has recently intensified its actions on the path to integration into the world community, in particular the European Union, the issue is to bring the national legal system in line with the legal standards developed by the international community, including in the field of providing legal aid in criminal cases in the form of extradition. In this regard, there is an objective need for proper and sufficient legal regulation of relations in the field of international legal assistance in criminal cases, in particular those arising in connection with the extradition (extradition), in order to ensure the effective implementation by the Ukrainian side of its contractual obligations and the prevention of the person’s ability to avoid criminal liability.
