ELECTRONIC DOCUMENT AS AN EVIDANCE IN THE CIVIL PROCESS OF UKRAINE AND FRANCE

Abstract
Many procedural scientistsIn were engaged in the problem of determining the value of an electronic document for the proving in civil proceedings. The traditional obstacle to the development of e-commerce is considered the problematic representation of an electronic document as an evidence. The use of information technology inevitably affects the actual activity of the court and other participants in the consideration of the case and the resolution of concrete legal case, including on the activities of proving. In the article author offers a definition of electronic documents, describes their use as evidence in Ukrainian and French legal procedure, raises the issue of the necessity of the use of electronic digital signature (EDS). In the article are also raised questions of determination of characteristics, that electronic document should correspond for the use it as evidence in civil proceedings. Also there were considered the terms of the probative value of electronic documents (formalization ad probationem) in French legislation.
