EXPERIENCE OF EU MEMBER STATES IN THE DEVELOPMENT OF EFFECTIVE VALUATION OF THE PROSECUTION SERVICE ACTIVITY

Abstract
The article analyzes the experience of the EU member states in the development and application of criteria for an effective valuation of the prosecutor’s office, illustrates, for example, the experience of Portugal in implementing European standards in the field of evaluating the efficiency of the prosecutor’s office. With the further possibility of applying better experience in the development of Ukrainian legislation. It has been found that various quantitative and qualitative criteria are used in the EU countries, in particular: the employee demonstrates leadership qualities; management of affairs and processes; strategic planning; crisis management; change management and communication with the public and the media. It has been determined that the evaluation of the work of prosecutors, in accordance with European norms and principles, is conducted at regular intervals on the basis of adequate, objective and established criteria, using the proper and fair procedure. It was emphasized that the training of prosecutors is based on objective factors, in particular on professional qualifications, abilities, honesty and experience. The following conclusions are made: the quality and efficiency of the functioning of the current model of appraisal of the effectiveness of prosecutors’ activity ceased to meet the expectations of Ukrainian society; The evaluation of work efficiency is an instrument for analyzing the activities of the organization and its employees, its purpose is to provide uniform standards that will be binding on all civil service bodies and institutions; The EU Consultative Mission, which cooperates with the state authorities of Ukraine, provided recommendations on the implementation of European standards for the evaluation of the effectiveness of the activities of the Prosecutor’s Office of Ukraine; the evaluation of the activities of Portuguese prosecutors is based not only on quantitative indicators, but also on qualitative, applying an objective, transparent procedure with the right of appeal and the decision of the inspection commission.
