FOREIGN EXPERIENCE IN ENSURING THE RIGHT TO A FAIR TRIAL IN CASES OF ADMINISTRATIVE OFFENCES

Abstract

The article raises the issue of the need to improve the national legislation on administrative liability of individuals in terms of observance of the right to a fair trial. The urgency of the research is justified by the necessity of developing a new legal position in relation to the matter in question, taking into account legislative amendments and integration of EU law in Ukraine. To solve this problem, the author analyses the proceedings and the legislative mechanisms ensuring the right to a fair trial in cases of administrative offences on the example of the United States of America, England, Spain, France, Poland, Czech Republic. For each of the researched foreign countries, the author analyses the existing legislation that guarantees the right to a fair trial, as well as selective analysis of procedural enactments regulating the procedure for adjudication in cases of administrative offenses. The article focuses on those particulars of adjudication in cases of administrative offenses that are not inherent to Ukraine, but can be useful in application. In the course of study of foreign experience, the author found out that the researched countries have different approaches to the distinction and the role of administrative offences in respective jurisdictions, and, therefore, the mechanism for observance of the right to a fair trial depends on whether the administrative offences are kept separately, or they form part of the criminal law and constitute criminal offenses. Based on the analysis of the researched jurisdictions, the conclusions were made as to which of the legal frameworks in the context of the matter in question are unacceptable for the implementation into the national legislation and which of legal enactments are promising for the application in order to improve of the observation of the right to a fair trial in the cases of administrative offences. In the conclusions, the author made concrete proposals to improve the procedure for adjudication in cases of administrative offenses in Ukraine utilizing foreign experience.
