Formation and development of the legislation of Ukraine on adoption

Abstract

The article examines the main stages of the formation and development of the legislation of Ukraine on adoption, implements a general description of the current normative legal acts governing the adoption process in Ukraine, defines the sequence of their adoption and the main aspects of their significance, especially in the part of legal regulation of the protection of childhood, rights and interests of a child, including the adoption, which is determined by the form of placement and method of protection of orphans and children, deprived of parental care. The author notes that the development of statehood and society at various stages of its existence significantly influenced the legal regulation of adoption and recognition of it as a form of placement of orphans and children deprived of parental care and the complete neglect of such institution. Since the first years of its independence, the Ukrainian state has actively built its own legal system, gradually abandoning the federal legislation and formulating national legislation that would correspond not only to the current state of political, socio-economic development of society, but also to take into account the international experience of law-making and enforcement. Not without exception, in this general process, became family law, in the part of legal regulation of child protection, rights and interests of a child, including an adoption, which is determined by the form of placement and the way of protecting orphans and children deprived of parental care. Many legislative acts regulate the procedure for the implementation of this important procedure, however, all of them are not devoid of certain shortcomings. Improvement of the modern normative base on adoption issues is always relevant, as in Ukraine, the number of orphans and children deprived of parental care is increasing, a significant part of which is being replenished by orphanages and boarding schools; therefore, the state must make its decisions with care, ensuring, first of all, the interests of a child.
