Fundamental and Formal Aspects of E-Commerce Crime Laws in the Low of Iran (The First Chapter: Formed Aspects – Jurisdiction)

Abstract
When the debate on criminal law enforcement is introduced under the general title of criminal procedure, the type and level of complexity of the obstacles and problems ahead will change considerably.Although the two areas of substantive and formal have a direct relationship with each other an effect on one another, but both the authority for action being more in substantive laws and challenging it being more difficult with respect to the formal area.It is worth mentioning that most of the violations of the rights of citizens occur in the formal process and it is for this reason why its regulation is codified with much more details then with substantive area. Since jurisdiction is one of the most important formal aspects of the E – Commerce crimes and in the better words criminal procedure and scientific detection, at the beginning in the first section we proceed with this discussion.
