General characteristics of the subjects of administrative legal relations in the field of advertising on the Internet

Abstract

The subjects of administrative legal relations in the field of advertising on the Internet can be advertisers, producers, distributors, consumers advertising and public authorities that manage in advertising on the Internet. The law "On Advertising" examinessuch subjects advertising: — Manufacturer of advertising — a person who is wholly or partly produces advertising; — Advertiser — a person who is a customer of advertising for its production and / or distribution; — Distributor of advertising — a person who carries out distribution of advertising. Also, the law "On Advertising" includes the term "sponsor". However, in Ukrainian legislation sponsor can`t be the subject of administrative relations in the field of advertising on the Internet. The law "On Advertising" mentioned another subject of advertising — union, or association of enterprises in the field of advertising. Administrative and legal status of the entity in the legislation of Ukraine on advertising defined only at the level of rights, duties and responsibilities of citizens' associations and associations of undertakings mentioned. But that does not exempt them from the duties and responsibilities as stipulated in the general rules of the law of Ukraine on associations. Unlike the law "On protection of consumers" , the law "On Advertising" stipulates that consumer advertising can be not only physical but also legal entities, which have known or can be proven advertising. The subject of administrative relations in the field of advertising on the Internet is a state that implements its functions through the appropriate authorities.
