GENERAL DESCRIPTION CONTRACT OF CARRIAGE OF PASSENGERS AND BAGGAGE

Abstract
Abstract-normative definition of passenger transportation contract and luggage under the Civil Code of Ukraine, the definition given in the transport charters and codes, sub-legal acts, established the specificity of legal relations on the carriage of passengers and baggage, determined by the characteristics of their legal regulation. The author focused on the need to separate categories of general (generalized approach to understanding the essence of passengers and their legal regulation at the level of the Civil Code of Ukraine, including at the level of the construction of the passenger and luggage carriage contract) and a separate or special (accounting features of transportation of passengers by different modes of transport where technical and technological properties of their impact on the contract terms, and thus produce the existence of the "subspecies" contracts of carriage of passengers). The author analyzes the regulations and the works of scientists in the study area; comments and positions on issues of concern and discussion. Supported the position of the need to clearly define the subject of the contract, which is based on transport services, which should correspond (except for conditions move the person in space) safety criteria, timeliness and comfort.
