GENERAL PROVISIONS FOR OVERCOMING THE COUNTERACTION TO JUDICIAL REVIEW OF CRIMINAL PROCEEDINGS

Abstract
The peculiarities of the tactics of coping with the judicial review of criminal proceedings are analyzed. It is determined that it provides for the ability to correctly analyze and evaluate the problem situation, to determine the range of tasks, to select the optimal means of their solution, to predict the change of the situation and to build on the knowledge of the laws of the emergence and development of counteraction. Taking into account the direction of counteraction to the judicial review and the practice of overcoming it, three stages of its development are distinguished: the stage of prevention, neutralization and termination. The measures aimed at avoiding the negative consequences of the counteraction were determined, as well as proposals were made to improve the current legislation and legal practice on the identified issues.
