Geneza kanonu 1370 Kodeksu Prawa Kanonicznego z 1983 r.

Abstract
W artykule zaprezentowano genezę przestępstwa przymusu fizycznego przeciwko duchownym i zakonnikom (kan. 1370). Autor analizuje kary za to przestępstwo w Dekrecie Gracjana, konstytucji apostolskiej Piusa XII (12.10.1869 r.), Kodeksie Prawa Kanonicznego z 1917 r., w Schemacie Papieskiej Komisji ds. Rewizji Kodeksu Prawa Kanonicznego z 1917 r. i w obowiązującym Kodeksie. Historyczna analiza kan. 1370 pozwala zrozumieć obecność tego przestępstwa w kanonicznym prawie karnym, a także dlaczego było ono surowo karane w Kościele Katolickim – karane ekskomuniką. W porównaniu jednak do wcześniejszych regulacji, kara za przestępstwo przymusu fizycznego przeciwko duchownym i zakonnikom została złagodzona.
