GRANTING LEAVE TO RECUPERATE TO PRIESTS EMPLOYED AS TEACHERS IN PUBLIC SCHOOLS

Abstract

Pursuant to articles of Teachers' Charter - a teacher who is on a full employment contract for an indefinite period of time and who has worked in a school for the period of at least seven years, may be granted by the school's headmaster leave to recuperate in order to undergo prescribed treatment. The length of the above mentioned leave may not exceed the period of one year on a one-off basis, and such leave may not exceed cumulative total of three years during the whole period of employment. A teacher who is on such leave retains the right to remuneration. Priests working in schools are also subject to provisions of the School Education Act and therefore they are also entitled to this leave. However, one of the requirements for taking this leave states that during the leave to recuperate a teacher is prohibited from entering any work relationship or engaging in any gainful activity. As a result, it is not possible to take leave to recuperate and at the same time perform parish duties. That is why granting leave to recuperate to priests employed in public schools is possible only if such priests are relieved of their pastoral duties and do not draw any remuneration.
