Haram Mal ve Haram Mal Sahibi ile Muamelenin İslam Hukukundaki Hükmü

Abstract
Bu araştırma, her Müslümanın hayatında büyük bir öneme haiz, haram mal, haram mallardaki tasarrufun niteliği, haram mal sahipleri ile nasıl muamelede bulunulması gerektiği meselelerinden ibaret olan çağdaş bir problemi konu edinmektedir. Bir Müs-lüman kasıtlı veya kasıtsız olarak herhangi bir sebeple haram bir mal elde edip sonra da Şeriatın hükümleri ve kurallarına uygun şekilde onu temizlemek veya elden çıkart-mak ya da haram mal sahibi bir kimse ile harama düşmeden muamelede bulunmak isteyebilir. Elimizdeki araştırmada bu konu üç başlık altında ele alınıp söz konusu prob-lemlere çözüm üretilmeye çalışılmıştır. Birinci bölümde âlimlere göre haram malın ta-nımını sıralanıp tercihe şayan olan tanıma değinilmiş ve haram malın çeşitleri açıklan-mıştır. İkinci bölümde haram maldan kurtulmak için meşru olan harcamalara atıfta bulunup, haram malı kazanan kimsenin kendi adına harcamasının caiz olup olmadığı konusundaki âlimlerin ihtilafına ve cevazı için bulunması gereken şartlara değinilmiştir. Son bölümde ise ister tümü haram olsun ister helal ile karışık olsun, ister haramlığı kesin olsun, ister olmasın haram mal sahipleri ile muamelede bulunurken dikkat edil-mesi gereken kurallara değinilmiştir.
