Health information in a context of right to private life: international- legal approach

Abstract
This article explores the category of health information from the perspective of the right to respect for private life. Only universal provision on the right to respect for private life is established at international law. Provisions, such like, human right to access medical information about their health are part of everyone’s right to access the personal information which it relates, access to information – is a component of the right to health, could be found only at recommenda- tory documents by different international governmental and non-governmental organizations. Based on the provisions of the universal international legal instruments, it is not possible to assert that rights related to health information includes into the right to respect for private life. It should be outlines such relationship between health information and right to respect for private right: the right of access to information on the health and / or information concerning health issues; the right to protection of health information with the confidentiality mechanisms. Detailed regulation of these aspects is carried out through soft law. Only the practice of ECHR and it’s evolutionary na- ture constitutes correlation between health information and right to private life. Based on ECHR practice health information could be defined as part of the right to respect for private life.
