HUNGER STRIKES AND FORCE-FEEDING IN PRISONS

Abstract

This study will try to give an overview and assess the international and European standards regarding the management of hunger strikes. We will analyse the international and European standards regarding the force-feeding a prisoner on a hunger strike. The paper will focus on the study of the ECtHR judgements regarding the force-feeding of hunger strikers. Also, we will address the U.S. case and the force-feeding of prisoners which is considered to be, in certain cases, an act of torture based on the international human rights standards. To close with, the study will attempt to go through the recent developments in the Romanian legislation, analysing the legislation and its conformity with the European principles and recommendations, bearing in mind the prohibition, in absolute terms, of torture or inhuman or degrading treatment or punishment.
