IMPARTIAL COURT AS A GUARANTEE OF HUMAN AND CIVIL RIGHTS AND FREEDOMS

Abstract
The article clarifies the concept of “impartiality of the court”. The various approaches to understanding the concept of “impartiality of the court” are revealed. The current legislation, which establishes and regulates the impartiality of the court, is analyzed. Particular attention is paid to the impartiality of the court as a guarantee of the rights and freedoms of man and citizen in the system of guarantees, as well as the ratio of concepts “impartiality of the court”, “judicial objectivity”, “justice of the court”. It is stated that impartiality, as a guarantee, applies to the entire judicial system and the status of judges in the state.
